Health & Rehab Solutions, Inc. (“HRS,”“we,” “us,” or “our”) is a business services company and the parent company to physical therapy practices located throughout the United States (each, an “Affiliate Practice”).  We operate our website, https://www.healthrehabsolutions.com (our “Site”) to provide information concerning our business and the services we offer to physical therapists interested in joining our group, identify and recruit potential partners, post job opportunities, and intake applications for employment with HRS and our Affiliate Practices. When we collect personal information about you through our Site, we use that information to improve your experience and our services, contact you about opportunities to partner with us, process any applications for employment you elect to submit through the Site, trouble-shoot problems, and answer your questions.  You can learn more about the personal information we collect and what we do with it in this policy (our “Privacy Policy”).  

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it.  If you do not agree with our policies and practices, you must discontinue your use of the Site.  We update this policy from time to time, so you should check back regularly for updates. Your continued use of this Site after we make changes is deemed to be agreement to and acceptance of those changes, so please check the policy periodically for updates.  

‍Scope of This Policy

This Privacy Policy does not apply to information collected by us offline (when you interact with our employees in person or over the phone) and it does not apply to websites operated by our Affiliate Practices, even if we provide a link to those websites for your information or use. HRS is not a covered entity for purposes of the Health Insurance Portability and Affordability Act of 1996 (“HIPAA”) and the Site is not designed or suitable for the submission of Protected Health Information subject to HIPAA (“PHI”).  Any PHI collected by an Affiliate Practice in the course of providing patient care is governed by such Affiliate Practice’s HIPAA Notice of Privacy Practices, and not this Privacy Policy.  Please visit the website associated with your clinic to review their HIPAA Notice of Privacy Practices and exercise your rights under HIPAA.

HRS is based in Montana and does not specifically target our services to the residents of any other state.  For purposes of this policy, “personal data” means any information that is linked or reasonably linkable to an identified or identifiable individual.  Common examples of personal data include your name and address, email address, account passwords and credentials, and data generated by your activity on our Site that can be used to identify you.  The categories of personal information we collect through our Site can include the following: Contact information you provide directly, such as your name, email address, mailing address, and phone number when you contact us, subscribe to communications, or complete a form. Recruiting and application information submitted through career pages or applicant tracking systems, including resumes, work history, references, and communication preferences. Recordings of job candidate interviews and related meetings, transcripts generated from such recordings, and derivative content such as summaries or suggested feedback.  Information submitted through surveys, contests, or promotional forms. Automatically collected information, such as IP address, browser type, device information, pages viewed, and referring URLs, collected through cookies and similar tracking technologies, including Google Analytics. Information related to website activity and recruiting interactions collected through website visitor identification and candidate-matching technologies, which may help us identify individuals who may be interested in career opportunities with HRS or its Affiliate Practices.

We may use information we collect to: Respond to inquiries and provide requested information or services. Process and manage job applications, including scheduling interviews and communicating application status updates. Send administrative, service-related, and, where permitted, marketing communications. Operate, maintain, secure, and improve our Site and business operations. Analyze Site usage and traffic trends. Support recruiting and talent acquisition activities, including targeted advertising. Investigate, establish and enforce our rights with respect to the Site, including violations of our Terms of Use. Comply with applicable laws, regulations, and legal obligations.

‍Text Messaging

If you provide your mobile phone number and consent to receive text messages from HRS or an Affiliate Practice, we may use that information to send recruiting updates, interview scheduling messages, service-related communications, and, where separately authorized, promotional communications. Message frequency varies. Message and data rates may apply. Text messaging originat or opt-in data and consent information will not be shared with third parties for their own marketing purposes. We may share mobile numbers with service providers that assist us in delivering text messaging services, applicant communications, or support services, subject to appropriate confidentiality obligations. You may opt out of text messages at any time by replying STOP. After you send STOP, you will receive one confirmation message and no further messages will be sent unless you opt in again.

‍Targeted Advertising

A primary purpose of our Site is to engage physical therapists who may be interested in joining our group.  For that reason, we have partnered with several prominent third-party advertising programs to serve our website visitors with targeted or personalized advertising.  “Targeted advertising” means displaying advertisements to you based on personal data that has been collected or inferred about you over time, often based on your internet activity on nonaffiliated sites or applications (such as social media).  We use pixels, web beacons, and other storage technologies from third parties, including Meta,Tiktok, and Google, to collect or receive information from our Site and elsewhere on the Internet and those third parties, including Meta, Tiktok, and Google, use that information to provide measurement services, target and deliver ads. We don’t share your contact details or similar information with our advertising partners, but each of our partners is collecting information about your browser, device, and internet activity using tracking technologies installed on our Site.

Candidate Identification and Matching

We have partnered with Expanential, Inc. (“Expa”) to recruit and source physical therapists for our open positions.  Expa identifies potential candidates who are in-market, verifies their contact details, and runs outreach over email, SMS and LinkedIn to confirm that a candidate is interested. Expa uses third-party services to analyze how users interact with their digital channels, including the chatbot that is integrated into our Site. When you interact with our chatbot, any personal information you provide will be collected by Expa for purposes of tracking your engagement with Expa’s services, building a candidate profile, and matching you with potential employment opportunities.  You can learn more about Expa’s use of your personal information by reviewing their privacy policy, available here:  https://expahealth.com/privacy-policy/.  

‍Employment Applications

We utilize Ashby’s applicant tracking and recruitment software to intake and process employment applications through our Site.  In addition to using your personal data to process your application, Ashby may use your personal information, including your name, email address, phone number and other contact details, to provide you with marketing communications, promotions, and special offers. If a background check is required as part of the hiring process, candidates will receive a separate disclosure and authorization consistent with applicable law before any background check is conducted.

‍Contentsquare Analytics
We use Contentsquare to analyze visitor digital behavior and replay a visitor’s experience on our Site, helping us identify areas of our Site that we can improve. Contentsquare also assists us in isolating issues that are mentioned in surveys or complaints, so that we can better identify when and where errors have occurred.  To provide this service, Contentsquare uses cookies installed on our Site that collect online identifiers (such as your IP address and user ID), behavioral data (such as mouse movements or scrolls, screen taps or zoom data, and time of engagement), and technical data (such as which pages of our Site you visited, your operating system, and type of web browser).  To learn more about Contentsquare’s processing of personal data, please review their privacy policy, available here: https://contentsquare.com/privacy-center/services-privacy-policy/.    

‍Google Analytics

We also use Google Analytics to help us understand how you engage with our Site.  We use this information to improve our content and build better features to enhance your experience.  Google Analytics uses a set of cookies to collect information about the visitors to the Site, which Google then reports back to us as site usage statistics.  When Google provides us a report, it does not personally identify individual visitors. However, Google Analytics does place persistent cookies on your computer. Cookies, tags, tracking pixels and similar technologies gather information about your browsing history, search history, and interactions with our Site and advertisements. Our Site includes both first-party cookies (installed by us) and third-party cookies and tracking technologies (installed by our service providers and advertising partners). These technologies are saved by your computer and will recognize your device in the future.  As discussed in further detail above, we use cookies and tracking technologies to understand how visitors use our Site, analyze traffic trends, and support business operations.  We may also use website visitor identification and recruiting technologies that help us understand website activity and identify individuals who may be interested in career opportunities.    

Your internet browser will enable you to select to receive or block cookies under various conditions.  However, should you choose to decline or block cookies by adjusting your browser settings, you may disrupt the operation of cookies that are essential to our Site. •Affiliate Practices: Information may be shared between HRS and Affiliate Practices for business operations, administration, and recruiting activities.

•Service providers: Vendors that provide services on our behalf, including website hosting, analytics, recruiting platforms, applicant tracking systems, visitor identification technologies, and communication platforms.

•Legal and safety purposes: When required by law, legal process, or to protect rights, property, or safety.

•Business transfers: In connection with a merger, acquisition, financing, reorganization, or sale of assets.

Our Site contains plug-ins and other features that integrate third-party social media platforms, like Facebook, Instagram, and LinkedIn.  You can activate these plug-ins manually by clicking on the icons located in the lower left-hand corner of our homepage.  If you do so, the collection and use of your personal data is subject to each company’s privacy policies.  We have no control over the collection and use of your information by Meta (Facebook and Instagram) or LinkedIn, should you elect to leave our homepage and visit their sites.  For your convenience, additional hyperlinks may be posted on our Site that link to external websites we do not control.  We are not responsible for, and this policy does not apply to, the privacy practices of other companies.  You should not assume that our policy applies to any external sites, or that the policies applicable to those sites are similar to ours.  You will need to review each site’s privacy policy to understand how your personal data will be collected and used by the owner of the site.

HRS is based in the State of Montana.  We value your confidence and trust in us and take the privacy of your information extremely seriously.  If you have a question or concern about this privacy policy and our use of personal information, please contact us.  Even if the law in Montana is different from your home jurisdiction, we will still do our best to resolve any requests you may have.

If you would like to access, correct, delete or obtain a copy of your personal data, please contact us at the email address below.  Remember to include “Privacy Rights Request” in the subject of your email, so we can get it to the right people.  Once we have received your request, the first thing we will do is determine if we have collected and retained any of your personal data.  If we are in possession of your personal data, we will confirm receipt of your request and contact you to verify your identity.  The method by which we will verify your identity may vary, depending on the type and sensitivity of your personal data, the risk of harm to you, and the technology available to you.  If we cannot verify your identity with reasonable certainty, we will deny your request and inform you that your identity could not be verified. Although you are under no obligation to cooperate with our efforts to verify your identity, we cannot act on your request until you have done so.

Please do not send us any sensitive personal information as part of your request. Should we require any information beyond your name and account number, we will contact you to discuss a secure and reliable means of transmitting that information to us.

Our resolution of your request will depend on the nature of the personal data and the purposes of our processing of your data.  We reserve the right to decline your request if we are unable to authenticate your identity, if we have a good faith, reasonable, and documented belief that your request is fraudulent, or if your request exceeds what is required of us under applicable law.  We may elect to fulfill your request without conceding the applicability of any legal requirement that would require us to do so.

‍Browser Controls for “Do Not Track.”  
Some browsers have incorporated “Do Not Track” features that can send a signal to websites you visit indicating that you do not wish to be tracked.  Because there is not yet a common understanding of how to treat these signals, you should use the “Do Not Track” feature in conjunction with another form of opt-out.  Many websites still collect and use your browsing data to improve security, provide content, services, ads and recommendations on their websites, and generate reporting statistics.

We use commercially reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and maintain appropriate business records. For recruiting purposes, we may retain resumes, application materials, and related information so we can consider candidates for current and future opportunities with HRS or its Affiliate Practices. Individuals may request removal of their information by contacting us.

Our Site is intended for a general business and adult audience and is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13.  If we learn we have collected or received personal information from a child under the age of 13, we will delete that information upon discovery.
